ACCELERATION CLAUSE A clause in a promissory note, agreement of sale, or mortgage which gives the lender the right to call all sums due and payable in advance of the fixed payment date upon the occurrence of a specified event, such as a sale, default, assignment or further encumbrance of the property. LESS-THAN-FREEHOLD ESTATE An estate held by one who rents or leases property. This classification includes an estate for years, periodic tenancy, estate at will, and estate at sufferance. ORIGINATION FEE Fee charged by a lender to cover administrative costs of processing a loan. COMMITMENT A promise to lend and a statement by the lender of the terms and conditions under which a loan is made. POCKET LISTING A listing which is retained by the listing broker or salesperson, who does not make it available to other brokers in the office or to other Multiple Listing Service members. PERCOLATION TEST A hydraulic engineer's test of soil to determine the ability of the ground to absorb and drain water. CONDOMINIUM A form of property ownership in which the homeowner holds title to an individual dwelling unit and a proportionate interest in common areas and facilities of a multi-unit project. DEVISE A transfer of real property under a will. ETHICS A system of moral principles, rules and standards of conduct. NOTE Legal document obligating a borrower to repay a loan at a stated interest rate during a specified period of time. The agreement is secured by a mortgage or deed of trust or other security instrument. GENERAL AGENT One who is authorized to perform any and all acts associated with the continued operation of a particular job or a certain business. BLANKET MORTGAGE A mortgage which is secured by several structures or a number of lots. A blanket mortgage is often used to finance proposed subdivisions or development projects, especially cooperatives. DOUBLE ESCROW An escrow set up to handle the concurrent sale of one property and purchase of another property by same party. EVICTION The legal process of removing a tenant from possession of the premises for some breach of the lease contract. REALTY Land and everything permanently affixed thereto. GOOD FAITH ESTIMATE Written estimate of the settlement costs the borrower will likely have to pay at closing. Under the Real Estate Settlement Procedures Act (RESPA), the lender is required to provide this disclosure to the borrower within three days of receiving a loan application. LOCK OR LOCK-IN A lender's guarantee of an interest rate for a set period of time. The time period is usually that between loan application approval and loan closing. The lock-in protects you against rate increases during that time. ECOA See Equal Credit Opportunity Act. COURTESY TO BROKERS The practice of sharing commissions with cooperating brokers. |
