However, the more points you pay, the more cash you need up front since points are paid in cash at closing. JUDICIAL FORECLOSURE A method of foreclosing upon real property by means of a court supervised sale. After an appraisal, the court determines an upset price below which no bids to purchase will be accepted. GROSS INCOME Total income before taxes or expenses are deducted. BREACH OF CONTRACT Violation of any of the terms or conditions of a contract without legal excuse; default, non-performance, such as failure to make payment when due. USURY Interest charged in excess of the legal rate established by law. JUMBO LOAN A mortgage larger than the $240,000 limit set by the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation. INTEREST RATE The annual rate of interest on the loan, expressed as a percentage of 100. REMAINDER ESTATE A future interest in real estate created at the same time and by the same instrument as another estate, and limited to arise immediately upon the termination of the prior estate. CONSTRUCTIVE EVICTION Acts done by a landlord which so materially disturb or impair the tenant's enjoyment of the leased premises that a tenant is effectively forced to move out and terminate the lease without liability for any further rent. |
